Laxman Rao COUNSEL FOR THE RESPONDENT No. 2 : The Public Prosecutor (AP[) Petition under section 438 of Cr.PC., praying that in the circumstances stated in the memo of grounds filed herein, the High Court may be pleased to release the petitioners on bail in the event of their arrest pursuant to the Crime No. 19 of 2015 of Women U/G P.S., Kadapa. the Court made the following ORDER:

The petitioner, who is accused No.1 to 3 in Crime No.19 of 2015 of Women U/G Police Station, Kadapa, registered for the offences under Sections 498-A and 506 IPC and Sections 3 and 4 of the Dowry Prohibition Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. The allegations against the petitioners are that they harassed the de facto complainant, who is the wife of 1st petitioner, by demanding additional dowry.

Learned counsel for the petitioners submitted that at the instance of her father, the de facto complainant has filed a false complaint against the petitioners and that they never harassed the de facto complainant. Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners. (Contd. 2. )

In the circumstances, the petitioners-A1 to A3 are directed to surrender before the Magistrate concerned, within ten days from today and on such surrender, they shall be enlarged on bail on their executing personal bond for a sum of Rs.5,000/- (Rupees five thousand only) each with two sureties each for the like sum each to the satisfaction of the said Magistrate. Further, the petitioners are directed to report before the Station House Officer concerned, daily between 10.00 a.m. and 5.00 p.m., for a period of (15) days and to cooperate with the investigation.
