HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION Nos.728 & 730 of 2017 COMMON ORDER:

The petitioners in the 2 quash petitions are accused Nos.1 to 6 respectively of crime No.40 of 2017 of Chandanagar Police Station, Cyberabad.

Heard both sides.

In the course of hearing, it is brought to the notice by the learned Public Prosecutor that police already filed final report in the said crime and the learned IX Metropolitan Magistrate, Miyapur, has taken cognizance for the offences covered by the FIR by allotting C.C.No.727 of 2017.

Hence, the Criminal Petition is closed by left open all available defence, remedy is available to the petitioners to impugn the police final report and the cognizance order with part II CD by fresh petition.
