2017-04-03A Ramalingeswara Rao1 pages

THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.11646 of 2017 ORDER:

This Writ Petition is filed challenging the inaction of the second respondent in registering the crime against the petitioner's brother-in-law pursuant to the complaint dated 07.06.2016.

The petitioner in his affidavit stated that the second respondent registered Crime No.189 of 2016 for the offence punishable under Section 306 IPC against the sister-in-law of the petitioner, but his present grievance is that his brother-inlaw was not shown as accused. If that is so, it is always open to the petitioner to produce necessary evidence either before the second respondent or before a higher authority and it is for them to take appropriate action. This Court cannot interfere with the process of investigation, as the crime is already registered. The Writ Petition is, accordingly, disposed of giving such liberty to the petitioner. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
