THE HONOURABLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.11010 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.3 and 4 seeking to quash proceedings in C.C.No.261 of 2016 on the file of the I Additional Judicial First Class Magistrate, Kadapa District, for the offences punishable under Sections 498-A and 506 IPC and Section 3 of the Dowry Prohibition Act. Heard learned counsel for the petitioners/accused Nos.3 and4 and learned Public Prosecutor and perused the material available on record. A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of C.C.No.261 of 2016 as expeditiously as possible, without insisting the presence of the petitioners/accused Nos.3 and 4 unless required for any specific purpose.

Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
