THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.P.M.P.No.2015 of 2016 & CRIMINAL PETITION No.2072 of 2016 ORDER:
This Criminal Petition is filed by the accused under Section 482 of Cr.P.C. seeking to quash the proceedings in P.R.C.No.14 of 2015 pending on the file of III Additional Judicial First Class Magistrate, Kakinada, East Godavari District.
When the matter is taken up for hearing, the de facto complainant filed Crl.P.M.P.No.2015 of 2016 stating that at the intervention of the elders and well wishers, the matter is settled among the parties amicably and therefore, the complainant is no more interested to prosecute the matter and seeks to quash the proceedings.
Both the parties as well as their counsel have signed on the memorandum of compromise annexed to Crl.P.M.P.No.2015 of 2016. The parties, who are present in the Court, also affirmed the same. A perusal of the affidavit filed in support of the petition goes to show that the matter was settled between the parties.
In view of the amicable settlement of the dispute between the parties, no purpose would be served in keeping the proceedings pending. Hence, the Crl.P.M.P.No.2015 of 2016 is ordered and the compromise is recorded. Consequent thereto, the Crl.P. is allowed and the proceedings in P.R.C.No.14 of 2015 pending on the file of III Additional Judicial First Class Magistrate, Kakinada are hereby quashed. It is directed that this compromise shall form part of the record. The petitioners-accused shall pay a sum of Rs.5,000/- to the State Legal Services Authority, Hyderabad towards costs on or before 8th March, 2016.
Miscellaneous petitions pending, if any, shall stand closed. _________________ RAJA ELANGO,J 23.02.2016.
