HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.16438 OF 2019 ORDER:

This writ petition is filed aggrieved by action of respondents 2 and 3 in interfering with life and liberty of the petitioner and with house property over plot bearing Sy.No.756/41, admeasuring 2148.67 square yards situated at Garmilla Village of Mancherial Mandal and District. Learned Assistant Government Pleader for Home produced written instructions stating as under: " It is respectfully submitted that the allegations made by the petitioner that on 27.7.2019 the respondents 2 and 3 have called him to police station and asked to get original documents of the property and to settle the land dispute by way of withdrawing the civil suit is false and denied herewith, as the respondent No.2 &3 have not called the petitioner to police station on 27.7.2019, nor asked him to withdraw any civil suit.

It is respectfully submitted that, infact a case is registered against the petitioner Poshini Venkata Swamy in Crime No.219/2019, U/s.420, 447, 427 IPC of Mancherial police station on 25.5.2019, basing on the complaint of one Pettem Ramakrishna. In the above case the petitioner Poshini Venkata Swamy is arrayed as Accused No.1.

It is submitted that keeping that in mind, the above case the petitioner had come up with present writ petition to bring pressure on the police officials, all the averments and contention raised in the writ affidavit are false are denied."

But, however, learned counsel for the petitioner says that the respondent-police are pressurizing the petitioner to

settle civil disputes inspite of petitioner having injunction in his favour in respect of subject property.

In view of the same, the writ petition is disposed of directing the respondent-police not to interfere with the civil disputes, threaten him to settle the civil disputes, unless any police aid is ordered by concerned Court.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 09-08-2019 Nvl
