Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner was appointed as a Fair Price Shop Dealer of Shop No. 19 of Cholasamudram village, Kuderu Mandal, Ananthapur District. The authorization of the petitioner was valid up to 31.03.2015 and the petitioner remitted amount for renewal of the authorization. While so, the third respondent submitted a report to the second respondent on 11.3.2014 stating that for the months of March, 2014 and July 2014, the petitioner supplied commodities to the bogus card holders. Based on the same, a show cause notice was issued to the petitioner on 13.3.2015. The petitioner submitted her explanation through an Advocate on 25.3.2015. Thereafter the second respondent suspended the authorization of the petitioner by order dated 31.3.2015. Challenging the same, the present Writ Petition is filed.
A reading of the impugned proceedings dated 31.3.2015 reveals that pursuant to the show cause notice dated 13.3.2015 the petitioner submitted her explanation through an Advocate on 25.03.2015. However, without completing the enquiry, the second respondent suspended the authorization of the petitioner by order dated 31.3.2015. In view of the submission of the explanation on 25.3.2015 by the petitioner, this Court is not inclined to entertain the Writ Petition at this stage. However, the second respondent is directed to complete the enquiry in respect of the charges levelled against the petitioner by duly observing the principles of natural justice and pass final order within a period of thirty days from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
