THE HON'BLE SRI JUSTICE G. CHANDRAIAH AND THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 25563 of 2015 ORDER:- (per Hon'ble Sri Justice Challa Kodanda Ram) Notice dated 31.07.2015 issued by the Assistant Commissioner (CT), LTU, Kurnool, is challenged before this Court raising various grounds.

The Notice sets out a Statement showing interest amount payable by the petitioner for the delay in paying the instalments which were granted at the instance of the petitioner.

2. Heard learned counsel for the petitioner as well as the learned Government Pleader.

3. Learned counsel for the petitioner submits that noticing the discrepancy in the calculation of the interest in the impugned Notice, the petitioner submitted their objections on 05.08.2015 and if the objections are taken into consideration, the amount payable would result in substantial reduction of interest payable.

4. The fact that the petitioner had filed a representation on 05.08.2015 is not being disputed.

5. In the circumstances, instead of keeping the writ petition pending, interest of justice would be served if a direction is

issued to the respondent-authorities to consider the representation dated 05.08.2015 and re-calculate the amounts payable, if any, after taking into consideration of the factual data mentioned by the petitioner. The said exercise shall be completed within two weeks from the date of receipt of a copy of this order.

6. The writ petition is, accordingly, disposed of. No costs. Miscellaneous petitions, if any pending, shall stand closed. ____________________ G.
