Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue writ or direction particularly in the nature of mandamus or any other appropriate writ, declaring the action of the respondents in marking the premises of the petitioner to demolish the structure in D.No.3-28-18/115/A, 2nd lane, Rajendranagar, Guntur without following the due process of law as illegal, arbitrary, and opposed to principles of law and natural justice and infringement of property right guaranteed under Article 300-A of Constitution of India and consequently direct the respondent authorities to follow due process of law. WPMP.NO: 4881 of 2015 Petition under Section 151 of C.P.C.
Praying that in the circumstances stated in the affidavit filed in the W.P., the High Court may be pleased to direct the respondents herein not to interfere or demolish the structures in the premises bearing D.No.3-28-18/115/A, 2nd lane, Rajendranagar, Guntur belonging to the petitioner, pending disposal of WP No.3678 of 2015 on the file of the High Court.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri P. Vijaya Kiran, Advocate for the Petitioner and Sri A. Pandu Ranga Rao, learned Standing Counsel for Respondent Nos.2 to 4, the Court made the following ORDER:
Heard the learned counsel for the petitioner. Sri A. Pandu Ranga Rao, learned Standing counsel takes notice for respondents 2 to 4 and seeks time for getting instructions.
Post after four (4) weeks in the motion list. Till then, status-quo obtaining as on today shall be maintained by both the parties.
