THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.40257 of 2015 ORDER:

The prayer of the petitioners in this case is as under: "The Hon'ble Court may be pleased to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of respondents in harassing the petitioners and threatening them with dire consequences to produce the brother of 2nd petitioner i.e., Burri Nagaraju to perform his marriage forcibly with the respondent No.5 and occupying the house of the 2nd petitioner by break open the lock and in not taking action against the respondent Nos.5 to 9 on a complaint given by the 1st petitioner dated:

24-11-2015 is highly arbitrary and illegal and pass such other order or orders as deem fit and proper."

The Inspector of Police, Jangaon Police Station (Urban), Warangal District, filed a counter-affidavit denying the allegation of the petitioners that the 3rd petitioner was detained in the police station along with his relations and was beaten. The Inspector also denied the allegation that the police threatened the petitioners to perform the marriage of B. Nagaraju with K. Sunitha. He concluded by stating that the police were not harassing the petitioners or threatening them with dire consequences for failing to produce B. Nagaraju and that they were pressurizing them to perform the marriage of B. Nagaraju with K. Sunitha.

No reply affidavit has been filed by the petitioners denying the afore-stated averments made in the counter-affidavit. The stand of the police authorities as set out in the counter - affidavit is taken on record. In the light thereof, no adjudication is warranted on merits.

Sri B. Muralidhar, learned counsel for the petitioners, is also agreeable to closure of the case recording the stand of the police authorities.

The writ petition is accordingly closed.
