HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14116 OF 2015 ORDER:
This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioner-A.2 seeking anticipatory bail in connection with Crime No.561 of 2015 on the file of Gajuwaka Police Station, Visakhapatnam City, registered for the offence under Sections 420, 473 r/w 511, 384, 509, 506 r/w 34 IPC.
The case of the prosecution is that the de facto complainant availed loan from A.1 and his son, the petitioner herein by mortgaging landed property and even after repayment of entire loan amount, they failed to transfer the property in the name of the de facto complainant. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
The allegations in the complaint are not so serious in nature and that it is purely a civil transaction between the parties. Considering the same, this Court is inclined to grant anticipatory bail to the petitioner herein since it will not cause any prejudice for further investigation. Hence, the petitioner-A.2 is directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the likesum to the satisfaction of the Magistrate concerned. Further the first petitioner is directed to report before the Station House Officer concerned daily between 10.00 a.m. and 5.00 p.m. for a period of fifteen days.
