HON'BLE SRI JUSTICE A.RAJASHEKER REDDY C.C.No.1097 of 2018 ORDER:
This contempt case is filed alleging violation of orders passed by this Court in WP.No.29845 of 2017, dated 04-09-2017. Learned Assistant Government Pleader for Services by producing a copy of proceedings dated 04-04-2019 states that the appeal filed by the petitioner was considered and disposed of by said proceedings. As such, there is no violation of orders passed by this Court.
On the other hand, learned counsel for the petitioner submits that by issuing impugned proceedings, the direction issued by this Court has not been followed in true spirit and it is an erroneous order.
In this case, it is to be seen that the respondent issued proceedings on 04-04-2019 in pursuance of the orders passed by this Court. Even if the said proceedings are erroneous, the validity of the same cannot be examined in the contempt case. In view of the same, I do not see any violation of orders passed by this Court.
Accordingly, the contempt case is disposed of granting liberty to the petitioner to challenge the proceedings dated 04-04-2019 in accordance with law. Pending miscellaneous applications if any shall stand closed.
