HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12680 OF 2003 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioner is challenging the transfer of respondents 3 to 6 corresponding to promotees at 4 to 6 & 8 of notice of list of promotees dated 28.6.2002 by respondents 1 and 2 to be effective only after the Senior Assistant vacancies in the twin cities are filled by the Assistants in the panel of promotees dated 28.06.2002.

It is further noticed that the Writ Petition against the respondents 3 to 6 was dismissed for default by orders dated 18.8.2010 and thereafter, the petitioner has not taken any steps to ensure that the Writ Petition against the contesting respondents is restored.

This Hon'ble Court was pleased to grant interim orders in favour of the petitioner on 1.7.2003.

Having considered the submissions made by the parties, this Court is of the considered view that this Writ Petition can be disposed of, directing the petitioner to make a fresh representation within one week and upon such representation being received, the respondents shall consider and pass appropriate orders within a period of four weeks thereafter. In view of the fact that the Writ Petition against contesting respondents was dismissed, this Writ Petition cannot be adjudicated on merits and accordingly Writ Petition is dismissed.
