THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1739 of 2016 ORDER:

1. This Criminal Revision Case is filed by the petitioner-Accused No.1 aggrieved by the order dated 21.6.2016 passed in Crl.M.P.No.794 of 2016 in C.C.No.46 of 2016.

2. The petitioner was charge sheeted for the offence punishable under Sections 498-A, 406 IPC and Sections 4 and 6 of the Dowry Prohibition Act. He was enlarged on bail in the above C.C. He filed the above Crl.M.P. seeking to grant interim custody of his passport as he intends to go to Saudi Arabia for his business purpose. The Court below ordered for return of passport of the petitioner on some conditions. One of the conditions is that the petitioner shall execute a self bond for a sum of Rs.5 lakhs with one surety. It is ordered that in case, the petitioner fails to appear before the Court below after six months, the bond that would be executed by him shall be forfeited and the said surety amount of Rs.5 lakhs shall be given to the de facto complainant. Aggrieved by the said condition, the petitioner filed this revision.

3. Heard and perused the material available on record.

4. Learned Additional Public Prosecutor opposed this revision.

5. Considering the facts and circumstances of the case, this Court is inclined to modify the above condition of execution of self bond as follows:

"The petitioner-A1 shall furnish a self bond for a sum of Rs.2,00,000/- (Rupees Two Lakhs only) with one surety for the

like sum. Rest of the conditions imposed in the order under revision shall remain."

6. With the above modification, the Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
