HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8237 OF 2016 ORDER:

This writ petition is filed for a Writ of Mandamus to declare the action of the 2nd respondent in not releasing petitioner's DCM Van bearing Registration No.AP 29 TB 0453 in his favour on furnishing third party security and undertaking as illegal and arbitrary and consequently direct the 2nd respondent to release the vehicle by accepting the third party security.

The petitioner is the owner of DCM van bearing Registration No. AP 29 TB 0453. On 15.02.2016 the said lorry was seized on the ground that it was transporting PDS rice. In spite of the petitioner filing a petition before the 2nd respondent on 25.02.2016 stating that he is unaware of the fact the rice being transported is PDS rice and requested for release of the vehicle on condition of furnishing third party security and also an undertaking that he will not change the colour and would produce the vehicle as and when required, no orders have been passed till date. Aggrieved by the same, the petitioner has filed the present writ petition.

Heard learned counsel for the petitioner and Government Pleader for Civil Supplies.

Having regard to the facts and circumstances of the case, since the petitioner's vehicle is alleged to be involved in transportation of PDS rice illegally, I see no reasons to interfere with the 6-A proceedings initiated by the respondents.

Accordingly, the writ petition is dismissed. No order as to costs. In view of the disposal of the main writ petition, miscellaneous petitions, if any pending in the writ petition, shall also be closed. ______________________________ CHALLA KODANDA RAM, J.
