THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.27481 of 2017 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development (A.P) for first respondent and learned Standing Counsel for second respondent.

The grievance of the petitioner in the present writ petition, as averred in the writ affidavit, is that in the name of digging drain, the officials of the second respondent-Municipality are encroaching upon the private property of the petitioner herein. 3.

On instructions, it is submitted by the learned Standing Counsel for the second respondent that if the private property of the petitioner is required for the purpose of widening the drain, the procedure in accordance with law will be adhered to by the second respondent.

The said statement is recorded and the writ petition is disposed of directing the respondents not to meddle with the private property of the petitioner herein, situated in R.S.No.453/6, bearing door No.4-19-44, 2nd Ward of Mandapeta Municipality and Mandal, East Godavari District, except in accordance with law. It is made clear that it is open for the respondents to acquire the private property of the petitioner, if the same is required for any public purpose, as per law.
