THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8288 OF 2013

O R D E R

The prayer of the petitioners in this case was as under: "For the reasons stated in the accompanying affidavit it is humbly prayed that this Hon'ble Court may be pleased to issue a Writ, Order or direction more fully one in the nature of Writ of Mandamus declaring the action of the 3rd respondent herein in preventing the petitioners herein to work as cooks for implementation of the Mid-day Meal programme in the 3rd respondent School as illegal, void and capricious and consequently direct the respondents to continue the petitioners as cooks for Mid-day Meal programme in the 3rd respondent School till they are removed from their respective posts under due process of law and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

It is not in dispute that the petitioners, whose services were selected for implementation of the Midday Meal Programme in the M.P.P. Elementary School in Barinepalle Village, M.C. Kothuru, Chittoor District, were discontinued in November, 2011. Aggrieved thereby, they filed the writ petition in the year 2013 and no interim orders were passed at that stage.

Learned counsel appearing for the respondents would state that an alternate agency was selected and is presently implementing the Midday Meal Programme in the school at Barinepalle Village.

In that view of the matter, the grievance of the petitioners has become stale and does not warrant adjudication on merits at this belated stage.

The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
