THE HON' BLE SRI JUSTI CE CHALLA KODANDA RAM I .A.No.2 of 2019 I N/ AND SECOND APPEAL No.234 of 2019 COMMON JUDGMENT:

This second appeal is filed by the defendant in O.S.No.1839 of 2010 on the file of III Junior Civil Judge, City Civil Court, at Hyderabad (for short, 'the trial Court'), challenging the Judgment and Decree dated 13.06.2019 passed by the IX Additional Chief Judge, City Civil Court, Hyderabad, in Appeal Suit No.288 of 2014 (for short, 'the appellate Court'). By the impugned Judgment, the appellate Court dismissed the appeal filed by the defendant, thereby affirmed the Judgment and Decree dated 28.07.2014 passed by the trial Court in O.S.No.1839 of 2010. The matter was heard in part at the admission stage. At that stage, considering the nature of dispute between the parties, both the parties have expressed their willingness to work out a workable solution. In accordance with the same, the appellant-defendant filed I.A.No.

2 of 2019 praying the Court to permit the parties to compromise the matter as per the Terms of Compromise enumerated in the Compromise Memo. The affidavit filed in support of the petition also discloses that with the mediation of well-wishers, the parties have arrived at an amicable solution to the dispute. Both the parties are present before the Court and they are identified by their respective counsel. Both the learned counsel submit that the parties have amicably settled the matter and mutually agreed to abide by the terms of the compromise memo appended to the Affidavit dated 14.08.

ia_2_2019 & sa_234_2019 CKR, J support of I.A.No.2 of 2019 and, therefore, pray that the second appeal may be disposed of by recording the compromise entered into between the parties.

In those circumstances, I.A.No.2 of 2019 is allowed, and the second appeal is disposed of by recording the compromise entered into between the parties. The Terms of Compromise Memo appended to the Affidavit dated 14.08.2019 filed in support of I.A.No.2 of 2019 shall form part of the order and record. No costs. Pending miscellaneous petitions, if any, shall stand closed.
