The petitioner/accused filed the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS), seeking to grant pre-arrest bail to him in Crime No.67 of 2026 of Boinpalli Police Station which was registered for the offence punishable under Section 314 and 316(5) of the Bharatiya Nyaya Sanhita 2023 (BNS).

Heard Mr. C. Kumar, learned counsel for the petitioner and Mr. M.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State.

The brief facts of the case are that on 21.03.2026 the de facto complainant lodged report stating that on 20.03.2026 during the cash verification conducted in KDCC Bank, Kodurupaka Branch, there was short Rs.2,20,000/-, and when questioned, the accused admitted to have used the said amount for personal needs and later repaid the said amount, as such, he requested Police to take action against accused.

Learned counsel for the petitioner submitted that though disciplinary proceedings have been initiated against the de facto complainant and the petitioner, criminal case is registered only against the petitioner. It is submitted that petitioner is under suspension and ready to cooperate with investigation. 5.
On the other hand, learned Assistant Public Prosecutor opposed the grant of pre-arrest bail to the petitioner stating that specific allegations are levelled against them. 6.
In view of the facts and circumstances of the case, taking into consideration that petitioner has already paid sum of Rs.2,20,000/- and he is ready to cooperate with the investigation,
this Court deems it fit to grant anticipatory bail to the petitioner/ accused.

Accordingly, this Criminal Petition is allowed and the petitioner/accused shall be released on anticipatory bail on the following terms and conditions:
i.
The petitioner shall surrender before the Station House Officer, Boinpalli Police Station, Rajanna Siricilla District, within two (2) weeks from today and on such surrender, the said Station House Officer shall release him on bail on his executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m. and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
