THE HON'BLE SRI JUSTICE P.NAVEEN RAO

CIVIL REVISION PETITION No.1742 of 2016 ORDER :

This civil revision petition is filed challenging the order passed in I.A.No.62 of 2015 in O.P.No.267 of 2013 on the file of the Family Court-cum-III Additional District and Sessions Judge, Warangal. The learned trial Judge on detail consideration of the claim of the petitioner made therein, awarded interim maintenance of Rs.7000/- per month and also Rs.10,000/- towards legal expenses. Even though the claim made by the petitioner therein was Rs.25,000/- per month, the trial Court awarded only Rs.7000/-. The petitioner herein ought to have been happy with the order passed by the learned trial Judge.

Though learned counsel for the revision petitioner sought to contend that petitioner has lost his employment and he is an unemployee having no job since 11⁄2 year, the same was not pleaded before the Court below and there is no such averment even in this revision petition. Hence, I see no error in the order passed by the court below and accordingly, the Civil Revision Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this civil revision petition shall stand closed.
