THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.5296 of 2017 ORDER:

This revision petition is filed under article 227 of the Constitution of India assailing the inaction on the part of the trial Court to dispose of I.A.No.240 of 2014 in I.A.No.80 of 2014 in O.S.No.127 of 2014.

Heard the learned counsel for the petitioners and perused the record.

A perusal of the record reveals that the petitioners filed O.S.No.127 of 2014 before the Court of Special Assistant Agent and Sub-Divisional Magistrate (Mobile Court), at Bhadrachalam, against the respondents seeking perpetual injunction. Along with the suit, the petitioners filed I.A.No.80 of 2014 under Order XXXIX Rules 1 and 2 CPC and the same was allowed. The petitioners filed I.A.No.240 of 2014 seeking police aid. The grievance of the petitioners is that the trial Court is not disposing of I.A.No.240 of 2014. The only relief sought by the petitioners is to direct the trial Court to dispose of I.A.No.240 of 2014 in I.A.No.80 of 2014 in O.S.No.127 of 2014.

In view of the submission made by the learned counsel for the petitioners, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the learned Special Assistant Agent and Sub-Divisional Magistrate (Mobile Court) at Bhadrachalam, is hereby directed to dispose of I.A.No.240 of 2014 in I.A.No.80 of 2014 in O.S.No.127 of 2014 as expeditiously as possible, preferably, within a period of three (3) months from the date of receipt of a copy of this order.

With the above direction, the Civil Revision Petition is disposed of. Consequently, the miscellaneous petitions if any pending in this revision petition shall stand closed. _________________________ T.SUNIL CHOWDARY, J 27th October 2017 Rns
