Learned counsel for the appellant called absent, no representation. As per proceedings on 2r.ro.2o2r also there was no representation and as the parties are not evincing any interest, the matter was directed to be listed today under the caption for dismissal. Hence, the presence or representation on behalf of the appellant is felt essential. In the absence of proper representation on behalf of the appellant I do not find any merit to adjourn the matter. Accordingly, the appeal is dismissed for default for non-prosecution.
