THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.16649 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of respondents 3 to 5 in taking action against respondents 6 and 7 as illegal and arbitrary and consequently to direct respondent No.3 to complete investigation and file a final report in crime No.47/2016 of Peddakothapalle Police Station, Mahaboobnagar District. Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Home. It is to be noted that earlier, the petitioner filed W.P.No.31426 of 2016 seeking the very same relief as sought for in the present writ petition i.e. questioning the inaction of respondents 3 to 5 in taking action against respondents 6 and 7. Vide order dated 20.10.2016, this Court disposed of the said writ petition directing the 5th respondent therein to complete investigation in crime No.47 of 2016 dated 19.05.2016 as expeditiously as possible and file a final report, if any, either way in accordance with law.
It is the grievance of the petitioner that though this Court passed the order in the month of October, 2016, directing the Police to complete investigation, till date no action has been taken by the Police.
When the grievance of the petitioner is with regard to inaction of the respondent-Police in not proceeding further inspite
of orders of this Court, the remedy lies elsewhere. The petitioner cannot file another writ petition seeking the very same relief. Having regard to the above, the Writ Petition is disposed of giving liberty to the petitioner to avail the remedies available under law.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
