This writ petition is filed to declare the action of respondents in fixing the pay of the petitioner in the category of Record tracer and not paying the salary with effect from 03-012014 and 05-09-2014 to the petitioner as illegal and arbitrary and contrary to the provisions of A.P.S.R.T.C. Service Regulations and Section 47 of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.
It is stated by learned counsel for the petitioner that in similar circumstances, this Court disposed of WP.No.26916 of 2017 and Batch, dated 23-10-2017 by following the Division bench judgment of this Court in W.A.No.380 of 2017 and Batch, dated 05-06-2017. The same is not disputed by Sri N.Vasudeva Reddy, learned Standing Counsel for the respondent-Corporation.
In view of the same, without expressing any opinion merits, following the judgment in W.A.No.380 of 2017 and Batch, the writ petition is disposed of holding that benefit of Section 47 of the Act shall be available only to those who are covered by the disabilities specified in Section 2(i) of the Act and it is open to the respondent-Corporation to take a decision on the grievance of the writ petitioner preferably within a period of three months from the date of receipt of a copy of the order also and the writ petitioner is at liberty thereafter to avail
their remedies in terms of judgment of the Supreme Court in Civil Appeal No.3529 of and Batch, dated 23-02-2017.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 23-04-2018 Nvl
