THE HONOURABLE SRI JUSTICE M. LAXMAN CRIMINAL PETITION No.5896 OF 2023 ORDER:

This petition is filed under Sections 437 and 439 of Criminal Procedure Code, 1973 (Cr.P.C) seeking to grant regular bail to the petitioner who is arrayed as accused No.2 in Crime No.332 of 2023 of Mills Colony Police Station, Warangal District. The offence alleged against the petitioner is under Section 306 read with Section 34 of the Indian Penal Code.

The sum and substance of case of the prosecution is that the deceased and accused No.1 who is the son of accused No.2 are allegedly studying in the same school. The deceased was subjunior to accused No.1. While the deceased was in UK, she got acquaintance with accused No.1. On account of studying in the same school, the acquaintance allegedly turned into love. At the instance of accused No.1, the deceased allegedly sent Rs.3,50,000/- to accused No.1 and his nominees. When the deceased demanded to pay back the said amount, accused No.1 allegedly threatened the deceased to disclose love affair to her
parents. Therefore, she felt agony with the insult made by accused No.1, she committed suicide while she was in UK. 3.
Heard learned counsel for the petitioner - accused No.2 and learned Additional Public Prosecutor for respondent - State. 4.
The suicide was committed in UK. The immediate cause for suicide was that it is the accused No.1 who threatened her to disclose the love affair in between them to her parents and it is accused No.1 who refused to pay back the money. 5.
Except the allegation of transfer of money to the present petitioner, there is no other material that the conduct of the accused No.2 has contributed the deceased to commit suicide. The petitioner was in remand for more than one (01) month. 6.
In the above facts and circumstances, this Court is inclined to grant bail to the petitioner-accused No.2 on certain terms and conditions.

Accordingly, the Criminal Petition is allowed and the petitioner-accused No.2 shall be released on bail on the following terms and conditions:
(i) The petitioner-accused No.2 shall be released on bail on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of I Additional Judicial First Class Magistrate, Warangal.
(ii) The petitioner-accused No.2 shall not directly or indirectly influence or make any witnesses or complainant.
(iii) The petitioner-accused No.2 shall make available with the investigating agency for proper investigation and he shall fully cooperate with the investigation agency. He shall not at in any manner which will be prejudicial to fair and expeditious investigation.
