ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioner, who is arrayed as accused No.2 in Crime No.101 of 2026 before Valigonda Police Station, Yadadri Bhuvanagiri District, registered for the offences punishable under

Sections 319(2), 318(4), 336(3), 338, 340(2), 61(2), 351(2) r/w. 3(5) of Bharatiya Nyaya Sanhitha, 2023.

The brief facts of the case are that on 17.04.2026, the complainant lodged a police report stating that one Bodapatla Venkata Reddy had availed loans for five vehicles from his company and an amount of Rs.59,50,000/- was sanctioned to him on various dates and the loans are still outstanding and that he had obtained loans from the complainant company by mortgaging agricultural land bearing Survey No.1011/E, admeasuring Ac.2.30 guntas, situated at Poddutur Village, Valigonda Mandal, Yadadri Bhuvanagiri District, which was registered under Document No.1/2022 dated 03.01.2022 before the Tahsildar and Joint SubRegistrar Office.

It is alleged that after default in repayment of the loan amounts, the complainant company verified the status of the mortgaged property and found that the mortgage had been illegally released and the patta transferred in favour of another person. Upon enquiry with the Tahsildar office, it was allegedly revealed that the release of the mortgaged property was fraudulently secured by using fake authorization letters, forged Aadhaar cards, fabricated company identity cards, and false documents.

conspiracy with other accused persons, arranged one Mandari Premanand to impersonate as an authorized representative of the company by using a fake company ID card before the Sub-Registrar Office. It is also alleged that another accused, Kandagatla Charan, was falsely projected as the company's authorized representative, while Kandula Damodar Reddy and Edla Maheshwar Reddy acted as witnesses to the fraudulent transaction. All the accused persons acted in furtherance of their criminal conspiracy and cheated the complainant company by creating forged documents, impersonating company representatives, and fraudulently securing release of the mortgaged land, thereby causing wrongful financial loss to the company. It is further alleged that when questioned by the complainant, accused Bodapatla Venkata Reddy abused and threatened him with dire consequences. Based on the same, present crime was registered.

Heard Mr.Gajanand Chakravarthy, learned counsel for the petitioner and Mr.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State. 4.

Learned counsel for the petitioner submitted that petitioner is an accused No.2 and anticipatory bail has been granted by the

trial Court vide order dated 07.05.2026 and the order copy has been filed before this Court. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition. 5.

Learned Assistant Public Prosecutor opposed the petition and submitted that no reasons have been given by the trial Court for granting of bail. He further submits that the accusations against the accused Nos.2 and 3 that they have impersonated and also created fake ID cards and executed registration documents, therefore, it is a grievous offence. Further, the investigation was not yet completed since the petitioner is absconding. Therefore, at this stage, granting of pre-arrest bail to the petitioner does not arise. Hence, he prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and considering that serious allegations are levelled against the petitioner and the investigation is yet to be completed, this Court is of the considered view that it is not a fit case for grant of anticipatory bail to the petitioner at this stage. 7.

Accordingly, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending, shall stand closed.
