HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.5621 of 2011 ORDER:

The grievance of the petitioners is not considering their case for appointment in the existing vacancies as per merit obtained by them by implementing G.O.Ms.No.1234 dated 15.09.2006 and consequential memo dated 29.09.2006 as illegal and arbitrary.

2. A perusal of the prayer in the writ petition would show that the petitioners are seeking employment in the State Government service. Any aggrieved person seeking employment in the State Government Service, whether it is regular or contract, has to avail the remedies as available under the Administrative Tribunals Act, 1985 (for short 'the Act'). The remedy as available under the Act is an efficacious and effective and the Administrative Tribunal is the Court of first instance to adjudicate the service disputes. But the petitioners without availing the said remedy, filed this writ petition which is not maintainable.

3. At the hearing learned counsel for the respondents submit that the same relief is sought in four other writ petitions which were listed today and sought leave of this Court to withdraw the same to avail the remedies as available under the Act.

4. Having regard to the above, the writ petition is dismissed

leaving it open to the petitioners, if so, advised, to avail the remedies as available under the Act. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
