THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.9668 OF 2016

O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.250/2014 on the file of XII Additional Chief Metropolitan Magistrate, Hyderabad, registered against the petitioners/A-1 to A-3, for the offence punishable under Sections 498-A, 406 IPC read with Section 6 of Dowry Prohibition Act.

Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible. The presence of the petitioners 2 and 3 / accused 2 and 3, shall not be insisted upon, except required for any specific purpose. The petitioner No.1 / accused No.1 shall appear before the trial court.

Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:05.07.2016 AVS
