Sri N. Sreedhar Reddy, learned Standing Counsel appearing on behalf of respondent Nos.2 and 3 places reliance on the averments in the counter affidavit at para Nos.2 to 4 and submits that the cause in the present writ petition does not survive any more.

Relevant para Nos.2 to 4 of the counter affidavit filed on behalf of respondent Nos.2 and 3 are extracted hereunder:

It is submitted that the Transmission Corporation of Telangana Limited is not laying any High Tension lines and is not erecting any towers at present in Sy.No. 473, 474, 475 and 476 of Kandukuru Village and Mandal, Ranga Reddy District. The TRANSCO is not associated with the laying of lines w3hich is subject matter of this writ petition. The allegations relating to these Respondents are denied.

3. It is submitted that the 4th respondent has obtained permission from Central Government

undertaking to lay independent lines which allows the 4th Respondent to wheel power from any generator. The 4th respondent is permitted to collect wheeling charges. The said scheme is known BOOM (Build, Operate, Own, Maintain) the power lines.

4. It is submitted that as per the said scheme it is sole responsibility of the 4th respondent to solve all right of way problems with the farmers and lay the lines after paying compensation to them. The 4th respondent has to negotiate with the land owners and erect transmission towers and lay the lines. These respondents have no control over the 4th respondents business and the 4th respondent is absolute owner of the power lines laid under the scheme".

For the submissions of the learned counsel appearing on behalf of the petitioner, post, 'for dismissal' on 02.01.2025.
