HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.27021 of 2003 ORDER :
This writ petition is filed to declare the action of respondents in not allotting Quarter No.4 as per Resolution No.524 dated 02.12.1980 as illegal, arbitrary and to direct the respondents to allot Quarter No.4 in terms of Regulation dated 02.12.1980.
2. When this matter has come up on 20.11.2015 and 26.11.2015 on the request of advocate for petitioner, adjournments are granted. In spite of that, no interest is evinced and today neither advocate for petitioner present nor any representation is made on his behalf.
3. Advocate for respondents submitted that petitioner has not made out any case and as per Resolution dated 02.12.1980, only a decision was taken to notify Quarter Nos.3 and 4 to the persons belonging to scheduled castes and defence and to call for applications from those categories and no decision is taken to allot Quarter No.4 to petitioner under above referred Resolution. It is submitted according to his instructions, petitioner died long back and on his death, his son is provided appointment on compassionate grounds in the Ongole Municipal Corporation and son of petitioner also died and that job was given to his wife and no cause survives as Quarter No.4 is not at all allotted to petitioner.
4. Considering these aspects, this writ petition is dismissed for nonprosecution.
5. Miscellaneous petitions pending, if any, shall stand closed. No costs.
