THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4551 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in crime No.505 of 2014 of the P.S., Punjagutta, Hyderabad District, pending on the file of the XIV Additional Chief Metropolitan Magistrate at Hyderabad, arising out of offences under Sections 406 and 420 IPC. Heard and perused the material available on record. Learned counsel for the petitioners submits that though the case is registered in 2014, the police has not filed charge sheet and as such, prays this Court to quash the proceedings against the petitioners herein.

On perusal of the entire material available on record, prima facie there are allegations against the petitioners, which are to be investigated into by the police. Hence, this Court is not inclined to quash the impugned proceedings at this stage. The petitioners are given liberty to file criminal petition if they are aggrieved over the charge sheet after filing of the same.

The Criminal Petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 01.04.2016 pln
