Petitioner challenges notification Ref.B2/ 3613/ 2016 dated 17.10.2016 issued by the fourth respondent for appointment of fair price shop dealers for shop Nos.14, 23, 2, 8, 1, 39, 25, 32, 24 and 31 as illegal, arbitrary and contrary to the lis pending in WP.No.23863 and 2015 and batch.

The primary grievance of petitioners is that the cancellation of authorization of petitioners has not attained finality for the cancellation is subject matter of WP.No.23863 of and batch.

If any permanent arrangement is made, in the event of petitioners being successful, they may not derive the benefit of adjudication. Hence, pray for stay of all further proceedings pursuant to notification dated 17.10.2016.

Learned Government Pleader appearing for respondents submits that the steps any taken by the fourth respondent are always subject to the outcome of the writ petitions and there is no need to stay the notification at this stage of the matter.

I have perused the material available on record and I am satisfied by placing on record the statement of learned Government Pleader, the writ petition can be disposed of and accordingly disposed of.
