Date : 13.10.2017 Between :
Smt Mairaj Fathima W/o late Mohammed Ghiasuddin 54 yrs R/o H No. 19-4-321/B/2/1/1 Kishan Bagh Bahadurpura, Hyderabad Petitioner And Sri Rathod Davuji The Deputy Director Survey & Land Records, Hyderabad district, Telangana & another Respondents The Court made the following:
ORAL ORDER:
This Court disposed of writ petition by order dated 20-2-2017 directing the Deputy Director, Survey and Land Records to examine the representation of the petitioner dated 25.10.2016 and to take appropriate decision as warranted by law. Further directions are also issued. Alleging non compliance of the said directions, this Contempt Case is filed.
2.
Learned Government Pleader produced memo Rc No.A1/1086/2014 dated 24.7.2017 informing the petitioner that his request for sanction of pension is rejected.
3.
Learned counsel for petitioner submits that order of this Court dated 20.2.2017 was received by respondents on 13.4.2017 and they were required to pass appropriate orders within six weeks thereafter, but decision is not made within the time schedule and was made much latter. 4.
It appears the order copy was received by Deputy Director on 13.4.2017 and six weeks time granted to take a decision in the matter was expired by the end of May, 2017. No doubt, there is some delay in taking a decision and respondent Deputy Director ought to have been careful in taking decision within the time granted or ought to have filed an application seeking extension of time. However, it cannot be said that there is inordinate delay and such delay cannot be said as deliberate and willful warranting initiation of further proceedings. Contempt case is accordingly closed granting liberty to the petitioner to workout his remedies, if so advised, against the decision communicated to him vide memo dated 24.7.2017. No costs. ______________ P NAVEEN RAO,J DATE:13.10.2017 TVK
