THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.15033 of 2014 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/accused in Crime No.187 of 2014 of Cheryal Police Station, Warangal District registered for the offences punishable under Sections 120 B, 177, 420, 423, 465 read with Section 34 IPC.

Heard the learned counsel for the petitioner and the learned Public Prosecutor for the respondents.

Admittedly, a private complaint was filed before the concerned Magistrate and the same was referred under Section 156 (3) Cr.P.C. to the police for investigation and report. On receipt of such complaint, the police registered the same as Crime No.183 of 2014 for the alleged offences and investigated into the case. It is stated that the matter is under investigation. Having regard to the facts and circumstances of the case, without going into the merits of the case, this Court is of the view that since the matter is under investigation, the petitioner is at liberty to approach this Court if he is aggrieved by the filing of charge sheet that may be filed after completion of investigation before the Court.

Accordingly, the criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
