The Hon'ble Sri Justice J.Sreenivas Rao Criminal Petition No.6872 of 2025 Order:

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarika Suraksha Sanhita, 2023 (for short, 'BNSS') seeking anticipatory bail to the petitioner/accused No.4 in Crime No.685 of 2025 of Vanasthalipuram Police Station, Rachakonda District, registered for the offences punishable under Sections 420, 406, 467, 468 and 471 r/w 34 of the Indian Penal Code, 1860 (for short 'IPC).

The case of prosecution in brief is that on 19.05.2025 at about 15:00 hours, the complainant lodged a complaint at Vanasthalipuram Police Statian stating that he is the GPA holder of one T. Sunitha Rani @ Sunita Rani Gogineni, owner of Plot No.8 (472 sq. yards) at Injapur village, purchased in the year 1997, and she has been residing in USA for over 25 years and visiting India only briefly and in January 2025, the complainant found that a poultry farm was illegally operating

on the said plot and on enquiry, he came to know that accused No.1 had impersonated Sunitha Rani, forged her signature and fraudulently sold the said plot to accused No.2 through registered sale deed dated 29.03.2022. Based on the said complaint, the present crime is registered against the petitioner/accused No.4 and other accused for the aforesaid offences.

Heard Mr. M.Prudhvi Raj, learned counsel representing Mr. R.Mangulal, learned counsel for the petitioner/accused No.4 and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner has not committed any offence and he was falsely implicated in this case based on the confession statement given by the other accused. He further submits that similar allegations were levelled against accused Nos.2 and 3 and they were already arrested and enlarged on bail vide order dated 06.06.2025 passed by the learned VII Additional Judicial

Firsts Class Magistrate, Ranga Reddy District, at Hayathnagar in Crl.M.P.No.172 of 2025. He further submits that the petitioner is not having any criminal antecedents and he be granted anticipatory bail as he is ready and willing to cooperate with the investigation and abide by the conditions as may be imposed by this Court.

On the other hand, learned Additional Public Prosecutor submits that the petitioner has committed grave offence and the investigation is in progress and at this stage, if the petitioner is granted anticipatory bail, there is every chance of his influencing the witnesses and interfering with the investigation. Hence, he prays to dismiss the criminal petition. 6.

Having considered the rival submissions made by learned counsel for the parties and on perusal of the material available on record, it reveals that accused Nos.2 and 3 in the aforesaid crime were already arrested and enlarged on bail. Even according to the learned Additional Public Prosecutor, the

petitioner is not having any criminal antecedents and six witnesses were already examined.

In view of the same, this Court is inclined to grant anticipatory bail to the petitioner/accused No.4, subject to the following conditions:

i. The petitioner/accused No.4 shall surrender before the Station House Officer, Vanasthalipuram Police Station, Rachakonda Commissinerate on or before 26.06.2025, and on such surrender, the said Station House Officer shall release the petitioner/accused No.4 on bail on his executing a personal bond for Rs.30,000/- (Rupees Thirty Thousand only) with two sureties for a like sum each.

ii. On such release, petitioner/accused No.4 shall appear before the Station House Officer, Vanasthalipuram Police Station, Rachakonda Commissionerate, on every Monday at 11:00 a.m. for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. After release, the petitioner/accused No.4 shall not influence the witnesses or interfere with the investigation.

iv. Petitioner/accused No.4 shall abide by the conditions stipulated under Section 482(2) of BNSS and shall cooperate with the Investigating Officer in the investigation.

Accordingly, the Criminal Petition is allowed. As a sequel, miscellaneous petitions, pending if any, stand closed.
