2019-09-23P.Keshava Rao2 pages

THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.22540 OF 2014 ORDER:

There is no representation on behalf of the petitioners. Heard the learned Government Pleader appearing for the respondents 1 to 3.

The prayer sought in the Writ Petition is as under:- "...to issue an appropriate Writ, Order or Direction, more particularly one in the nature of writ of Mandamus declaring the action of the respondents 2 and 3 in interfering with the petitioners' personal liberty by calling him to their concerned Police Station and harassing them to settle the civil disputes with the third parties as illegal, arbitrary and unconstitutional and to issue consequential direction to the respondents not to interfere with the petitioners' personal liberty by calling them to settle the civil disputes with the third parties and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." Learned Government Pleader placed on record the written instructions dated 01.09.2014 issued by the Sub-Inspector of Police, Sircilla Police Station, Karimnagar District, which are made part of the record.

A perusal of the said written instructions would reveal that the respondents 2 and 3 i.e. the Superintendent of Police, Karimnagar and the Sub-Divisional Police Officer, Sircilla Sub-Division, Karimnagar, never harassed and interfered with the life and liberty of the petitioners by calling them to their

offices and asked them to settle their civil disputes with the third parties.

It is also mentioned in the said written instructions that there is a civil dispute between the petitioners and one Gangula Bhavani in O.S.No.16 of 2014 on the file of the Senior Civil Judge, Peddapalli, Karimnagar District, for which the respondents have nothing to do with the same. In view of the said specific instructions, this Court is of the opinion that no further cause would survive in the Writ Petition. Accordingly, the Writ Petition is closed.

There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed. ______________________ (P.KESHAVA RAO, J) 23rd September 2019 RRB
