THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.14060 OF 2018 ORDER:

In this writ petition, a writ of mandamus declaring the action of the 2nd respondent in not taking steps for withdrawal/cancellation of the Look Out Circular (L.O.C.) issued against the petitioner, as per letter, dated 27.03.2018, of the 3rd respondent as illegal and arbitrary is sought coupled with consequential direction to the 2nd respondent to take necessary steps forthwith for withdrawal/cancellation of aforestated L.O.C., as the petitioner has to travel to U.S.A. along with her two children.

I have heard the submissions of Sri Raj Kumar Rudra, learned counsel for the petitioner, and of the learned Government Pleader for Home (TG), appearing for the respondents 1 to 3. I have perused the material record.

Learned counsel for the petitioner brings to the notice of this Court the contents of the letter, dated 27.03.2018, addressed by the Inspector of Police, Madhapur, Cyberabad to the Commissioner of Police, Cyberabad, requesting to address a letter to the concerned for withdrawal of L.O.C. against the petitioner herein, who is the 3rd accused in a case in Crime No.307 of 2017 on the file of Madhapur Police Station and further submits that despite such letter addressed by the officer concerned, the 2nd respondent did not take any action in the matter and hence, the writ petition is filed.

Learned Government Pleader for Home would submit that the Commissioner would take suitable action and address a letter to the 4th respondent/concerned officer for doing the needful in the matter.

Recording the submissions, the Writ Petition is disposed of directing the 2nd respondent to act on the request of the Inspector of Police, Madhapur, Cyberabad, in the letter, dated 27.03.2018, in accord with the procedure established by law, as expeditiously as possible, preferably, within ten (10) days from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
