CIVIL MISCELLANEOUS APPEAL No. 692 OF 2016 J U D G M E N T : {Per the Hon'ble Sri Justice Suresh Kumar Kait} Aggrieved by the order dated 24/06/2016 passed in I.A.No.336 of 2016 in OS.No. 20 of 2016 by the IV-Additional District Judge, Kakinada, FAC XII-District Judge, Pithapuram, dismissing the application filed by the petitioner/plaintiff under Order XXXVIII, Rule 5 and 6 and Section 151 of CPC seeking to direct the respondent/defendant to furnish security for the suit amount to the satisfaction of the Court within time prescribed by the Court and order conditional attachment before judgment of the petition-schedule property, this Civil Miscellaneous Appeal is filed by the petitioner/plaintiff.
2. When the matter is listed today, Sri A.K. Kishore Reddy, learned counsel appearing on behalf of the appellant seeks permission of this Court to withdraw this Civil Miscellaneous Appeal.
