HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CONTEMPT CASE No.1014 of 2017 ORDER:

The present Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act stating that the respondent has willfully and deliberately disobeyed the order dated 02.01.2017 passed by this Court in W.P.No.46653 of 2016, wherein this Court directed the respondent authority to dispose of the application dated 13.12.2016 made by the petitioner seeking issuance of pattadar pass books and title deed, in accordance with law, as early as possible, preferably, within a period of eight (08) weeks from the date of receipt of a copy of the order.

A counter came to be filed by the respondent stating that the application of the petitioner was considered on 12.04.2017 and the same was rejected, as the brother of the petitioner namely Tambireddy Raghava Reddy, made an objection that he is the owner of the subject property and pattadar pass book and title deeds were granted in his favour on 28.01.2016 in respect of the subject land. 3.

At this stage, learned counsel for the petitioner submits that an appeal is filed before the appropriate authority against the said rejection. Having regard to the above, as the respondent has already considered the representation and passed orders on 12.04.2017, it cannot be said that there was any willful disobedience of the order passed by this Court. Hence, the Contempt Case is closed.

Consequently, miscellaneous petitions, if any, pending shall stand closed.
