THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39418 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the inaction of respondents 3 & 4 in not conducting investigation in Crime Nos.195 of 2012 and 95 of 2013, dated 03.11.2012 and 31.01.2013, as illegal and arbitrary. The case of the petitioner is that the petitioner lodged a complaint before the 3rd respondent, which was registered by the 3rd respondent as Crime No.195 of 2012 on 03.11.

2012, alleging that after purchase of the alleged property, the petitioner along with his entire family were residing in the said house property without any interruption or hindrance from any person and that respondents 5 to 7 along with their unsocial elements trespassed into the house property and when the petitioner has shown the original title deeds, they were not ready to heed to the requests of the petitioner and threatened the petitioner with dire consequences and started throwing the household articles and that on hearing hue and cry of the family members of the petitioner, respondents 5 to 7 fled away from the house and while leaving, they posed serious threats to the petitioner and his entire family members. It is further case of the petitioner that on 31.01.

2013, respondents 5 to 7 trespassed into the property and break open the locks which were put by the 3rd respondent's office and broke open the seal of the seized property upon which, the then officer of the 3rd respondent's office have given a complaint before the 4th respondent, which is registered as Crime No.95 of 2013, dated 31.01.2013, against respondents 5 to 7. The main grievance of the petitioner is that even though the above said complaints are registered as Crime Nos.

7 nor completing the investigation and dragging the issue without taking any action in accordance with law against respondents 5 to 7. Considering the grievance of the petitioner, respondents 3 & 4 are directed to complete the investigation in Crime Nos.195 of 2012 and 95 of 2013, as expeditiously as possible and file a final report, if any, either way in accordance with law, preferably within a period of three (3) months.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 16th November, 2016 KL
