THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37996 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a direction to respondent Nos.1 to 3 herein to provide police protection to the petitioners over their possession in the property to an extent of Ac.1.39 guntas in Sy.No.199 situated at Jogipet Village, Medak District and also to implement the orders passed by this Court in S.A.No.6 of 2014. 2.

Heard and perused the material available on record. 3.

Learned counsel for the petitioners submitted that the petitioners filed O.S.No.5 of 2004 on the file of the Senior Civil Judge, Medak against the unofficial respondents for perpetual injunction and the same was decreed on 17.10.2012. The unofficial respondents challenged the same by filing A.S.No.84 of 2012 on the file of VIII Additional District and Sessions Judge, Medak and S.A.No.6 of 2014 before this Court and the same were dismissed confirming the order passed by the trial Court. In spite of the same, the unofficial respondents are constantly interfering with the possession of the petitioners in the aforementioned land. The trial Court was also pleased to order police aid to the petitioners vide E.A.No.8 of 2013 in O.S.No.5 of 2004 on the file of the Senior Civil Judge, Medak.

Though the local police came to the spot, they are unable to provide suitable protection to the property of the petitioners. So, they made a representation to the Director General of Police, State of Telangana, Hyderabad on 20.10.2016, but till date, no action is taken to dispose of the said representation.

In view of the above said submissions, the Writ Petition is disposed of with the following direction:

The Director General of Police, State of Telangana, Hyderabad is hereby directed to dispose of the representation, dated 20.10.2016, of the petitioners as expeditiously as possible preferably, within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
