THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.10609 OF 2013 O R D E R :

Petitioner has filed this Writ Petition apprehending dispossession by the respondents of the land admeasuring Acres 2.05 cents in R.S.No.220/2 of G.Kothapalli Village, Dwaraka Tirumala Mandal, West Godavari District, without following due process of law.

Petitioner is an assignee of the subject land and is in possession and enjoyment of the same even according to the counter filed by the 2nd respondent.

In the counter affidavit filed by the 2nd respondent, it is stated that no action has been initiated to dispossess the petitioner from the assigned land and there is no threat to dispossess him. 4.

Therefore, this Writ Petition is allowed and the respondents are directed not to interfere with the peaceful possession and enjoyment of the petitioner over the subject land without following due process of law. There shall be no order as to costs. 5.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
