THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 39842 of 2014 ORDER:

This Writ Petition is filed for the following relief: "...to issue an order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondent police registering the case under Sections 304(II), 379 IPC 5 of 181 M.V. Act by treating the crime as "Culpable Homicide not amounting to Murder" instead of U/s.302 IPC, 120-B, R/W 34 IPC and 5 of 181 M.V. Act, as high handed and arbitrary action, unconstitutional, and as such, Direct the respondents to re-investigate the crime vide F.I.R.No.59/2012, Dt 18.09.2012 of Uppunuthala (PS.), Mahaboobnagar Dist., forthwith." Sri S. Rama Mohan Rao, learned Assistant Government Pleader for Home, appearing for respondents submits, on instructions, that in respect of the subject crime, charge sheet was filed and accused were acquitted on 19.05.2017 in C.C.No.23 of 2013.

In those circumstances, the cause in this Writ Petition does not survive for consideration.

Accordingly, this Writ Petition is closed.

Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
