Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondents in not conducting survey of petitioner's land admeasuring Acs.2.91 cents situated in Survey No.501/ 9 of Srungavarapu Kota Village and Mandal, Vizianagaram District by fixing boundary stones and not issuing E-Pass Book for petitioner's in respect of the above land, as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondent-authorities for conducting survey in respect of the above said land.

Learned Government Pleader for Revenue would submit that the entries made in the revenue records do not indicate land in possession of the petitioner. But, however, the petitioner claims that he is in possession of the land in dispute and has documentary evidence to prove the same.

Having regard to the above submission, the writ petition is disposed of directing the respondent-authorities to consider the representation made by the petitioner with regard to conducting of survey only in respect of land referred to above after perusing the documents submitted by the petitioner. It is needless to mention that the authorities shall also issue notice to the aggrieved persons, if any before conducting survey.
