HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5422 OF 2015 ORDER:

This Criminal Petition is filed by the petitioner/A1 under Section 482 Cr.P.C seeking to set aside the order dated 07.05.2015 in Crl.M.P.No.1161 of 2015 in Crl.M.P.No.3266 of 2014 in C.C.No.71 of 2015 on the file of IV Additional Metropolitan Sessions Judge, Hyderabad, wherein cognizance was taken for the offence punishable under Sections 498-A, 448, 352 and 509 I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor (Telangana) for the State. The accused is A1 among three accused or so. He was granted the concession of anticipatory bail by the learned IV Additional Metropolitan Sessions Judge, Hyderabad in Crl.M.P.No.3266 of 2014 dated 12.09.2014. One of the conditions imposed in the said bail order was to deposit passport of the petitioner. The petitioner filed Crl.M.P.No.1161 of 2015 to relax the said condition on the ground that he is getting a prospective employment in Advanced Communications & Electronics Systems Company Limited, Riyadh and thereby he has to obtain a Visa. The learned Judge dismissed the said application. Aggrieved by the same, the petitioner preferred the present petition.

The learned Public Prosecutor contended as contended by the Additional Public Prosecutor in the lower Court that once the petitioner's passport is allowed to be taken out, he may jump the bail and it is difficult to secure him when he wants to go abroad

by leaving the country.

As the petitioner wants to leave the country to get job for very purpose he is seeking and the bail conditions is to secure his presence to face the trial. This Court feels that rather than returning the passport to the petitioner, it is just to direct the trial Court to expedite the trial and complete the same within two months from today so as to take his chance of taking back the passport after dismissal of the case.

With the above direction, this Criminal Petition is disposed of.
