THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.21144 of 2017 ORDER: (per SK,J) This writ petition was filed assailing the action of the State Bank of India in seeking to sell the residential house belonging to the petitioner under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. A consequential direction was sought to the bank not to sell the said house property. Sri Podila Hari Prasad, learned counsel on caveat for the first respondent bank, would however inform this Court that the subject house property was already put to sale by way of an auction and the sale certificate was registered yesterday in the name of the successful bidder. That being so, the cause in this writ petition does not survive for consideration on merits.

The writ petition is accordingly dismissed leaving it open to the petitioner to avail appropriate remedies in accordance with law. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
