THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.100 of 2014 ORDER:
This Criminal Petition is filed by the petitioners - Accused Nos.1 to 3 under Section 482 Cr.P.C., seeking to quash the proceedings in CC No.1805 of 2013 on the file of the III-Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, for the offences punishable under Sections 420, 406 and 506 IPC and 3 & 4 of the Dowry Prohibition Act.
Heard and perused the material available on record. Learned counsel for the petitioners as well as the learned Public Prosecutor are not able to inform about the stage of the case before the trial Court. The case pertains to the year 2014. No stay was granted by this Court earlier. Having regard to the facts and circumstances of the case, this Court is inclined to pass the following order:
The learned III-Additional Chief Metropolitan Magistrate, Nampally, Hyderbad is directed to proceed with the trial of CC No.1805 of 2013, if the trial is not completed, as expeditiously as possible. However, the presence of the petitioners before the trial Court is disposed with except on the dates on which the trial Judge insists for their presence and they shall represent through their counsel on all hearing dates before the trial Court.
Accordingly, the Criminal Petition is disposed of.
Miscellaneous petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J February 16, 2016.
