THE HON'BLE SRI JUSTICE S.V.BHATT C.R.P. No.2734 of 2018 ORDER:

Heard Mr.Ravi Kiran Rao for petitioners.

The learned trial Judge through the order impugned in the CRP accepted the prayer for amendment of reliefs, by incorporating the following alternative prayer: "A decree may be passed in accordance with law in view of changing circumstances of the parties in view of death of defendant No.1"

Mr.Ravi Kiran Rao contends that accepting the alternative prayer without foundation in the pleading is impermissible in law. He alternatively contends that since the revision petitioners have not filed additional written statement pursuant to amendment now ordered, liberty may be given to revision petitioners to raise all the objections available in this behalf.

Both the submissions are noted and this Court is pursuaded to place on record, the second objection made by Mr.Ravi Kiran Rao.

By granting liberty to that extent, Civil Revision Petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
