HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4729 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C. by the petitioners/A1 to A3 seeking to quash the proceedings against them in Cr.No.39 of 2018 of Mogulapalli PS., Jayashankar (Bhupalapally) District registered for the offences under Sections 448, 323 r/w 34 IPC and Section 3(1)(r)(s)(w), 3(2)(Va) of SC and ST (POA) Act, 2015.

2) Investigation is reported to be in the nascent stage. 2) Having regard to the nature of the complaint allegations, this Court is of the considered view the investigation shall proceed with. However, Investigation Officer shall strictly follow the guidelines of the Apex Court rendered in Arnesh Kumar vs. State of Bihar1 and also the procedure contemplated under Section 41A Cr.P.C during the course of investigation towards the petitioners/A1 to A3, in turn the petitioners shall cooperate with the investigating agency for smooth completion of investigation. 3) The Criminal Petition is accordingly disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
