Respondents have filed counter affidavit stating that they have initiated the enquiry and suspended the responsible police personnel in respect of the custody death of one Sri Shaik Hyder in the 3rd respondent-police station.

In view thereof, nothing further survives in the public interest litigation and the same is disposed of. It is open to the petitioner to take appropriate proceedings, if the circumstances so demand.
